Profepa sanctions

Just saw this on Riviera Maya News!
 
Tulum, Q.R. – The Federal Attorney for Environmental Protection (Profepa) has imposed closures on several Riviera Maya businesses. Restaurant La Buena Vida, Akumal Dive Adventures as well as two properties, Tlalocan and Nah Nah were all closed due to their environmental impact on the coastal region of the Riviera Maya. Both La Buena Vida and Akumal Dive Adventures had been sanctioned by Profepa back in 2005 for building without a permit. The recent closure of these businesses was due to lack of authorization from the Ministry of Environment and (Semarnat) to establish and operate in the federal maritime zone (Zofemat). Tlalocan was shut down for generating environmental damage with the installation of a pool, walkways and wall without permission. Nah Hah was found guilty of generating irregular discharge of liquid waste due to construction. They were cited for environmental damage. Profepa also carried out inspections on Hotel Villas Akumal to determine the degree and damage of sewage discharge being released into the mangroves. Inspections on Hotel Villas Akumal were set in motion after numerous public complaints were received by the newly established Profepa office. Fines can be as high as 50,000 times minimum wage, as according to the General Law of Ecological Balance and Environmental Protection as well as restoration damage imposed by Propepa.

Yes, I read that too today.  However, LBV is and has been open for business based on LG'rs that were or are still there. MB

Yeah LBV is open. 
 
I would think that there are bigger issues at hand than building permits from 2005, if they are chasing violations in the area.  Just sayin

Kay... Thanks for the update on LBV... I'd hate to see that one shut down.  Hoping to revisit my favorite RM watering hole in less than a month!!

Busy at La Buena Vida yesterday - not even a clausurado sign
 
I have only spotted 3 in the Half Moon Bay area (a condo bldg., a new store front under construction across from La Joya, and  a squatters shack at the end of the road - none in Akumal so far

A couple more:
 
I did see on at Akumal Dive Adventures but it is not that noticeable. I was looking because of the LBV news. Also, there is a huge one in front of La Sirena but on the waterfront property, not on the main road. They are out in full force.

Personally, I think PROFEPA should be focusing on issues around AKUMAL Bay rather than Half Moon Bay.

There was a clausurado sign on Mi Casa del Mar a few weeks back. I tried to look into it but didn't find anything. Does anyone know what happened there?

They had one on their front entrance when I was there 2 years ago.  Same one I presume.  It was for construction without a permit.

Mi Casa del Mar has a long history of violations.  If memory serves, their top floor was not in their building permits, and they went ahead and did it. The neighbor at Casa Magna, went to court. It cost her thousands of dollars and I think a few years and she won that they were in violation.  The courts said they had to remove the top floor.  Its still there.

Any more updates on closures?  Mi familia is heading there.  Already paid my $50.00 reservation deposit with Akumal Dive Shop for fishing trips.

I'm trying to digest what this means ...
 
a) Profepa violations are easy to ignore?
b) this was resolved out of general view (a little money changed hands between LBV and Profepa to make it go away)?
c) the matter isn't settled yet (some sort of appeal going on in the background, or negotiating what the penalty will be)?
d) something else I haven't thought of?
 
If LBV can evade Profepa, I imagine it will be easy for snorkel tours to do the same.
